  • Representing contractors and specialty subcontractors in state and federal cases involving public and private works such as:
    • The General Services Administration building in San Francisco is the new federal building at 7th and Mission Streets.  It was the first LEED Silver federal building completed in June 2007.  Numerous claims arising from material problems, owner-generated change orders and other problems relating to achieving the Green certification have been alleged to have caused uncompensatable change order and delay claims.  The firm currently represents one of the major subcontractors in this Federal Miller Act claim for recovery of change orders, inefficiency and delay claims, and is also defending claims by the prime contractor for disputes arising from this LEED Silver certified government facility.
    • Currently representing the largest U.S. specialty subcontractor in one of the largest construction defect cases in California (currently involving over 80 defendants and alleged damages of over $500 million).  Allegations include defective structural steel ceiling supports, inadequate compression posts, exterior wall defects and other life-safety issues which caused the closure of a casino operated by tribal authorities on tribal land.
    • Assisting large civil contractor in a federal claim in excess of $8 million for work done at a Northern California remediation site.
    • Defense of subcontractor in action to recover delay damages against the subcontractor for the alleged failure to deliver State-owned building on schedule.  Liquidated damages of over $6 million were imposed against the contractor by the public entity.
    • Represented subcontractor in connection with a claim in excess of $30 million for water intrusion and other defect issues at the western regional headquarters of a national insurance company; was able to obtain full defense and indemnity for the client from the excess OCIP carrier, who had initially contested that client was covered by policy.
    • Represented contractor in a differing site condition claim in the remediation of DDT-contaminated soils at the United Heckathorn Super Fund site.
    • Represented subcontractor in connection with significant water intrusion and other defect issues at virtually all window openings allegedly due to defective exterior stucco and window design and installation at a multi-story office and laboratory complex at U.C. Santa Barbara campus.
    • Represented exterior wall system subcontracts against multi-million dollar claim for water intrusion, mold remediation and other defective conditions involving a medical office building in Folsom, California.
    • Represented the subcontractor that installed the electronic security system at the Oakland Airport for alleged failure of the system to operate as specified.
    • Represented a subcontractor, in federal district court, in connection with alleged failure to comply with numerous ADA issues in the design and construction of the Kodak Theater in Los Angeles.
    • Represented prime contractor and obtained summary judgment on subdivision bond in large Sacramento-area subdivision.
  • Representing developers:
    • Advised owner/developer of major Auto Mall in Livermore in construction of five dealerships.
    • Represented owner of Livermore property in the remediation of contaminated soils where plume had migrated beneath several large commercial buildings.
